General Terms of Business
Before you place an order, please read the following terms and conditions.
1. General
We have taken great care in the presentation of our products on our website. The images you see, however, will depend on your monitor’s display and colour capabilities. Therefore we are unable to guarantee that the product images you see accurately represent the products.
By submitting an order to us through this website, you represent and warrant that the payment details you provide are valid and correct, and that you agree to abide by PayPal's own Terms and Conditions.
2. Definitions
‘You’ and ‘Your’ means the person ordering the goods under these Terms and Conditions.
‘We’ and ‘us’ means Matchbox Tackle Ltd.
‘Working day’ shall mean every calendar day apart from weekends and bank holidays.
3. Acceptance of your order
You receive an email from PayPal confirming your order. We cannot be held responsible if such an email fails to arrive.
Acceptance of your order and completion of the contract between you and Matchbox Tackle Ltd will take place when your order is dispatched.
Non-acceptance of your order may be the result of:
· The product you ordered being temporarily out of stock – see Availability.
· A problem with your payment.
· Other reasons.
4. Price
The prices payable for goods and services that you order are set out on our website.
Delivery is added at our rates at time of purchase: for our current delivery rates please see the delivery section.
Prices quoted are inclusive of VAT at the rates applicable at the time of purchase.
5. Payment methods
Payment can be made in three ways:
· When ordering through our website, you can pay through PayPal using their accepted methods. It is not necessary to be a PayPal member to purchase from us using PayPal.
· If ordering by email or telephone, payment can be made by cheque. There is a minimum order of £10.00 when paying by cheque. Cheques should be made out to "Matchbox Tackle Ltd." and sent to Matchbox Tackle Ltd, details on the contact us page, Cheques must be received before orders will be dispatched.
· Email or telephone orders can also be paid for via PayPal's Virtual Terminal link, details of which will be inserted into your confirmation email or invoice of goods.
6. Returns
If and only if the product we deliver does not accord with the product ordered, we will either offer a refund or send out the correct product to you at no extra cost.
7. More about Returns/Availability/Order Cancellation.
If we have insufficient stock to deliver the goods ordered by you within the Delivery Time, we will notify you as soon as possible to offer a refund and/or alternatives as befit the situation. Failure to reply within 10 working days will result in the canceling of your order and a refund. We will not be obliged to offer any additional compensation for disappointment suffered.
If any Products supplied should be defective or different from those ordered Matchbox Tackle Ltd will provide an immediate full refund on return of Products.
Goods exchanged or replaced for reasons other than complaint will be subject to our postage and packing charges for new orders. We will not accept responsibility for postal charges or lost items when returning non-defective goods. All returned non-defective goods must be in stock condition and in the original packaging.
8. Delivery
We will deliver the goods to the delivery address provided in your order.
Delivery will be by First Class post or Recorded Delivery and reserve the right to change the courier to best match the requirements of any orders. Proof of postage will be retained for all consignments sent.
Ownership of the goods you have ordered will pass on their being delivered to you or to the person you nominate and to whom we have agreed to deliver. We are liable for damage to or destruction of the goods whilst they remain under our responsibility.
Delivery to some outlying areas may not be possible or may be subject to surcharge. This may also apply to orders from overseas. In such an event, we shall contact you prior to despatch.
9. Delivery times
We aim to dispatch your order within 5 working days.
10. Liability
Matchbox Tackle Ltd. shall have no liability to you if the goods delivered are damaged, defective or of incorrect quantity unless you notify us of the problem in writing within 10 working days of delivery.
If you do not receive the goods within 10 working days of your order, we shall have no liability unless you notify us within a month of your order.
11.Force Majeure
We shall have no liability to you for any failure to deliver goods you have ordered, or for any delay in doing so, or for any damages or defect to the goods delivered that is caused by any event or circumstance beyond our reasonable control.
12. Severability
If any part of these conditions is unenforceable, the enforceability of any other part of these terms will not be affected.
13. Information
We hate junk mail just as much as you do, so we don't sell or pass on personal information that you give us. As previously stated we do not store any financial details such as card details.
14. Governing Law
It is agreed that this contract shall be governed by and be interpreted in accordance with English law and that the English courts shall have jurisdiction over any disputes arising under it.
15. Entire Agreement
These terms and conditions, together with our prices, delivery details and contract details set out the whole of the agreement between you and Matchbox Tackle Ltd. This clause does not exclude any liability for fraudulent misrepresentation.
These terms and conditions cannot be varied except in writing signed by a director of Matchbox Tackle Ltd.. Nothing said or written should be understood as a variation of these Terms of Business. We shall have no liability for any such representation being untrue or misleading.
16. Third Parties
This contract does not give effect to any of the provisions of the Contracts (Rights of Third Parties) Act 1999.
PRIVACY POLICY
Financial Details: Matchbox Tackle Ltd does not store any financial details of it's online or mail order customers in any way.
MatchBox Tackle Ltd knows that you care how information about you is used and shared, and we appreciate your trust that we will do so carefully and sensibly. This notice describes our privacy policy. By visiting MatchBox Tackle Ltd, you are accepting the practices described in this Privacy Notice.
What personal information about customers do we collect?
